Undrgradz operates a private social platform. This Privacy Policy describes the personal information we collect, the purposes for which we use it, the parties to whom we disclose it, and the rights and choices available to you in respect of it.
This Policy applies to the Undrgradz mobile application, the website located at Undrgradz.com, and all features and services offered through them (collectively, the “Service”). It forms part of our Terms of Service, and capitalized terms that are not defined in this Policy have the meaning given to them there.
ELYSA USA LLC (“Undrgradz,” “we,” “us,” or “our”), with an address at 17843 Camino Grande St. San Antonio, Texas 78257, is the entity responsible for the personal information described in this Policy.
Access to the Service is restricted to persons who are at least 18 years of age.

We confirm that a user has access to an electronic mail address issued by an eligible college or university. That is the extent of our verification. We do not confirm that any user is in fact enrolled at any institution, we do not conduct criminal background checks, and the presence of a badge on a profile does not constitute any representation or warranty regarding the person to whom that profile belongs. Please review Section 12 of our Terms of Service before meeting any user in person.
Registration information: your name, a username, your date of birth, an electronic mail address issued by your institution, a password, a telephone number, and any referral code you enter.
Profile information: photographs and other media, your biographical description, your responses to prompts, your institution, your field of study, your class year, your place of residence or origin, the languages you speak, and the interests and lifestyle attributes you elect to display. Certain of these fields are optional, and certain of them may reveal sensitive information; see Section 2.
Preferences: the users you wish to be shown and the criteria you establish for that purpose.
Content you generate: messages and media exchanged with other users, groups you create or join, activities you publish or attend, requests you send, and reports you submit to us.
Transaction information: confirmation of any purchase, the item or plan acquired, and its status. We do not collect or store your full payment card number, which is processed by the applicable application store or payment processor.
Communications with us: support requests, safety reports, complaints, and any other communication you address to us.
Use of the Service: the features you access, the content and profiles you view, the users with whom you interact, the actions you perform, the duration of your sessions, and your responses to notifications.
Device and technical information: device model, operating system, application version, language settings, device identifiers, network and carrier, IP address, and crash and diagnostic data.
Approximate location: ordinarily at the city or campus level, derived from your IP address and from the information you provide. If you enable location permissions on your device, we may use a more precise location for features that depend on distance. You may disable that permission at any time through your device settings.
Cookies and similar technologies: see Section 6.
From the electronic mail system of your institution, solely the confirmation that a verification code was delivered to an eligible address. We do not access your mailbox, your grades, or your student records. From application stores and payment processors, confirmation of the status of a purchase. From other users, where they invite you, interact with you, or submit a report concerning you. And from the providers identified in Section 5, acting on our behalf.
Certain information you may elect to provide is afforded special protection under applicable law. On a service of this nature, that information may include information relating to your sex life or sexual orientation (which may be revealed by the genders in which you indicate an interest), racial or ethnic origin, religious beliefs, political opinions, precise geolocation, identification documents, and biometric data generated in a verification process.
We do not collect health information. We do not request, and the Service provides no fields for, medical conditions, diagnoses, treatments, medications, disabilities, or reproductive or mental health, and we do not use lifestyle responses such as diet or exercise to draw any conclusion regarding the health of any person.
We process sensitive personal information only with your separate and express consent, or where another legal basis applies, such as the establishment or defense of a legal claim or the protection of the safety of a person.
Information that is necessary, optional, and conditional.
Withdrawal of consent. You may withdraw your consent at any time through Settings → Legal & Privacy, or by written request addressed to privacy@undrgradz.com. We will cease using the information concerned and will delete or anonymize it, except where we are required to retain it in order to comply with applicable law, protect the safety of a person, prevent fraud, or establish or defend a legal claim. Withdrawal of consent in respect of information upon which a feature depends will result in the deactivation of that feature, and withdrawal of consent to a verification that constitutes a condition of access may result in your being unable to continue using the Service.
Inferences. Our systems rank and recommend content by reference to your activity and other signals, and any ranking system may produce indirect correlations. We do not intentionally create profiles intended to infer sensitive characteristics you have not elected to provide, except where necessary for a feature you have requested and with the consent required by applicable law. We do not sell this information and we do not use it for advertising purposes.
Preferences. Where the Service permits you to establish preferences or filters by reference to personal attributes, those preferences constitute your own election, operate solely upon information that other users have elected to publish, and affect only the content displayed to you and the order in which it is displayed. They are not used to deny any person access to the Service. Certain optional attributes are not made available in all jurisdictions. The use of any preference to exclude, target, or harass any person or group by reason of a characteristic protected by applicable law contravenes our rules, and we may restrict, disable, or remove any preference.
We will not collect an identification document, a verification photograph, or biometric data without your consent. The granting of that consent is at all times your decision, and no such information will be obtained from you in its absence; however, as set out in Section 2, the granting of consent may constitute a condition of opening an account, of maintaining it, or of accessing particular features. Should you decline, you may be unable to use the Service or the feature concerned. We state this expressly so that no user is misled as to the meaning of “voluntary” in this context.
Prior to any such submission, we will inform you of the information to be collected, the specific purpose of its collection, and the period for which it will be retained, and we will obtain your written consent separately.
We use this information solely to confirm eligibility, age, or that you are the person depicted in your photographs. We do not use it for advertising purposes, we do not sell or lease it, and we do not disclose it, except to the verification provider acting on our behalf under contract, where you have authorized such disclosure in writing, or where required by law, warrant, or court order.
Retention and destruction:
We may amend this schedule, the technology employed, and our biometric practices from time to time in accordance with applicable law, providing the notices and obtaining the consents that such law then requires.
To operate the Service: to create and secure your account, verify eligibility, display your profile, present users, activities, and content to you, deliver messages, and administer requests and participation in activities.
To personalize the Service: we may personalize, rank, order, filter, and recommend profiles, activities, and content by reference to the preferences you provide, your activity within the Service, and other signals.
To operate paid features: to process purchases and subscriptions, deliver the benefits acquired, and prevent abuse of trials, promotions, and referral rewards.
To protect the community: to detect and act upon impersonation, fraud, scams, spam, automated accounts, accounts belonging to minors, harassment, non-consensual imagery, threats, and other violations; to review reports; and to enforce removals and prevent the return of removed users.
To secure the Service: to authenticate users, prevent unauthorized access, and maintain logs and audit records.
To communicate with you: to send account, security, and transactional messages; to respond to your requests; and, where you have elected to receive them, to send marketing communications.
To improve the Service: analytics, measurement, research, and testing, using aggregated or anonymized information wherever practicable.
To comply with applicable law: legal, tax, and regulatory obligations, lawful requests from competent authorities, and the establishment or defense of legal claims.
Automated processing and human review. Our recommendation and abuse-detection systems operate on an automated basis. We do not take decisions producing legal effects concerning you, or similarly significantly affecting you, based solely on automated processing: prior to the permanent removal of an account, the matter is reviewed by a natural person. You may address a request to privacy@undrgradz.com in order to obtain information regarding such processing, to express your point of view, or, where applicable law confers the right, to object.
Artificial intelligence. We do not sell your personal data for the training of third-party artificial intelligence models, and we do not use the content of your private communications to train generative artificial intelligence models. Should this change, we will inform you prior to any such change taking effect and will obtain any consent required by applicable law.
To other users. Your profile and the content you publish are visible to those users able to locate you, subject to the settings you have established. Content you transmit within a conversation is visible to its recipients.
To our service providers. Hosting and storage, content delivery, electronic mail and text messaging, push notifications, analytics, error reporting, customer support, moderation and trust-and-safety tools, verification, and fraud prevention. Such providers act upon our instructions under written contract, and may use your information solely as necessary to provide the services for which they have been engaged and for the related purposes that such contract permits, including security, fraud prevention, and legal compliance, and not for their own independent purposes. They are prohibited from selling it.
To payment platforms. The application stores and payment processors that process purchases.
To third parties whose offers we display. Where we display an offer or discount from another business, we do not provide that business with your personal information by reason of the offer having been displayed to you, although the provider serving or measuring the offer may process technical information as necessary to deliver it. Should you elect to redeem the offer, we will disclose the information necessary to validate your eligibility, and from that point the privacy policy of that business will govern the information you provide to it.
For legal and safety purposes. Where we believe in good faith that it is necessary in order to comply with applicable law, a subpoena, a court order, or a lawful request; to enforce our Terms; to prevent fraud or security incidents; to protect the rights, property, or safety of any person; or to report suspected exploitation of a minor to the competent authorities, as required by law.
To colleges and universities. Where we consider it appropriate in order to protect the safety of any person, or where required by law, we may report conduct occurring on the Service, together with the information associated with the account and the activity concerned, to the institution with which the user is affiliated, as well as to law enforcement or other competent authorities.
To other users following the removal of an account. Where required by applicable law, or where we determine it appropriate in order to protect users, we may notify persons who have interacted with an account that we have removed for conduct such as fraud, harassment, or a safety violation. We do not disclose the identity of any reporting user.
Copyright counter-notifications. Should you submit a counter-notification in response to a copyright complaint, we will forward it, including the name, address, and other contact information contained in it, to the person who submitted the original complaint, as required by applicable copyright law.
In the event of a corporate transaction. In connection with a merger, acquisition, financing, reorganization, insolvency, or sale of assets, of which we will inform you.
Upon your instruction, or with your consent.
Aggregated or anonymized information that cannot reasonably be used to identify you. We undertake not to attempt to re-identify it.
We do not sell your personal information, whether for monetary or for other valuable consideration. We do not sell sensitive personal information or biometric data. We do not share or disclose your personal information for targeted or cross-context behavioral advertising, and we do not permit third parties to collect personal information about you through the Service for their own advertising purposes. Should this change, we will amend this Policy, provide notice prior to the change taking effect, and make available the opt-out mechanisms required by applicable law.
We employ technologies that are strictly necessary (authentication, sessions, and security), functional (language and user settings), and analytical (feature performance and error reporting). We maintain an inventory of the third-party components integrated into the application and the website, and each provider is engaged as a processor or service provider under written contract.
Where required by applicable law, we obtain your consent prior to the use of any non-essential technology, by means of a mechanism that permits you to accept, to refuse, and subsequently to modify your election, refusal being no more burdensome than acceptance.
You may additionally manage cookies through your browser and limit advertising identifiers through your device settings.
Opt-out preference signals. Where we receive a Global Privacy Control signal, or any universal opt-out mechanism recognized in your jurisdiction, we treat it as a valid request to opt out of any sale or sharing of personal information from that browser or device.

The deactivation of a category of processing may limit or disable the features that depend upon it.
We retain your information for so long as your account subsists and for so long as is necessary for the purposes set out in this Policy. Where a fixed period cannot be stated, we determine it by reference to the purpose of the processing, the applicable limitation periods, and our legal obligations.

Graduation does not result in the deletion of your account. Your account is reclassified as an alumni profile and remains subject to this Policy until you delete it.
Deletion. Upon deletion of your account, we commence the deletion or anonymization of your information within 12 months and complete its removal from our backup systems within 24 months.
Information retained following deletion. We may retain limited information in order to comply with applicable law; to preserve material that is the subject of a report to the competent authorities, for such period as the law requires; to comply with a preservation order or litigation hold; to resolve disputes and enforce our agreements; to establish or defend legal claims; to maintain the security of the Service; and to maintain a minimized record of accounts removed for serious violations, so as to prevent the return of a removed user. Records of the latter category are limited to the identifiers strictly necessary for that purpose and are retained for 12 months.
Communications. The deletion of a conversation from your view does not effect its deletion from the device or account of the other participant.
We maintain administrative, technical, and physical safeguards, including encryption in transit and at rest, access controls on a least-privilege basis, secure credential storage, logging and monitoring, due diligence in respect of our providers, and an incident response procedure.
No system is entirely secure, and we are unable to guarantee absolute security. We recommend that you use a strong and unique password. Where an incident affects your information, we will provide notice to you and to the competent authorities in the manner and within the periods required by applicable law.
Information concerning other persons. Where you invite a person, identify a person, or upload content in which another person appears, you are responsible for having the right to do so. You must not provide the information of another person without that person’s consent.
The Service is not directed to, and may not be used by, any person under 18 years of age, or under the age of majority in the jurisdiction in which that person resides where that age is higher. We do not knowingly collect information from minors. Should we become aware that we have done so, we will delete the account and the associated information without delay. Should you believe that a minor is using the Service, please write to privacy@undrgradz.com.
Depending upon the state in which you reside, you may hold the rights set out below. We provide the rights required by the privacy law applicable to your state, and we may voluntarily honor equivalent requests submitted by residents of states whose law does not apply to us.
Your rights. Subject to verification and to the exceptions permitted by law, you may: know and access the personal information we hold concerning you and obtain a copy of it; correct it; request its deletion; obtain it in a portable format; opt out of the sale of personal information, of sharing for targeted advertising, and of profiling producing legal or similarly significant effects, although, as set out in Section 5, we do not engage in any of those practices; limit the use of sensitive personal information to that which is necessary in order to operate the Service; withdraw any consent; and exercise each of the foregoing without being subjected to discriminatory treatment.
Procedure. Requests may be submitted within the application under Settings → Legal & Privacy, by electronic mail to privacy@undrgradz.com, or by mail to P.O. Box 1122 Eagle Pass, Texas 78852. We respond within 45 days, which period we may extend by a further 45 days where necessary, informing you of the reason for the extension. We must be able to verify your identity, which we ordinarily do by confirming that you control the electronic mail address associated with the account. The exercise of your rights is free of charge. Under California law, requests to know may be limited to twice in any twelve-month period. We may decline requests that are manifestly unfounded or excessive, and will state our reasons for doing so.
Authorized agents. You may act through an authorized agent, from whom we may require written authorization and verification.
Appeals. Should we decline a request, you may appeal by written communication addressed to privacy@undrgradz.com bearing the subject line “Privacy Appeal” within 60 days. We respond to appeals within 60 days, or within such shorter period as applicable law requires, in writing, setting out the reasons for our determination. Should we deny the appeal, you may submit a complaint to the Attorney General of your state or to the competent privacy authority.
Referral rewards. Our referral program confers in-app benefits where persons you invite join the Service. Under California law, such a program may constitute a “financial incentive.” Participation is entirely voluntary, you may cease participating at any time by not using your referral link, and a decision not to participate has no effect upon your access to the Service. We have valued the program in good faith by reference to the reasonable cost to us of the additional in-app features, which is nominal, and we consider that the value of the personal information involved bears a reasonable relationship to that cost.
California — Shine the Light. California Civil Code § 1798.83 permits California residents to request information regarding disclosures of personal information to third parties for those third parties’ own direct marketing purposes. Requests may be addressed to privacy@undrgradz.com.
Categories of personal information. The categories of personal information we collect, their sources, the purposes for which we use them, and the categories of recipients to which we disclose them for business purposes are those set out in Sections 1, 4, and 5. We have not sold or shared personal information, including sensitive personal information, and we have no knowledge of the sale or sharing of the personal information of any person under 16 years of age.
Texas. We do not sell sensitive personal data or biometric data. Should that change, we would provide the notice required by the Texas Data Privacy and Security Act in advance.
Consumer health data (Washington and Nevada). We do not collect consumer health data. We do not request information concerning physical or mental health, diagnoses, treatments, medications, or reproductive health; we do not use any information you provide in order to infer a health condition; and we do not operate geofences in the vicinity of health care facilities.
Nevada. Residents may direct us not to sell certain covered information. We do not sell such information; requests may nevertheless be addressed to privacy@undrgradz.com.

Our data protection officer, where one has been appointed, and our representative in the European Union and in the United Kingdom for the purposes of Article 27 of the GDPR and of the UK GDPR, may be contacted at EURepresentative@undrgradz.com at P.O. Where we rely upon legitimate interests, we have conducted a balancing assessment, in respect of which you may request information or raise an objection.
Your rights. You hold the right to obtain access to your personal data; to obtain its rectification; to obtain its erasure; to obtain the restriction of processing; to data portability; to object to processing founded upon legitimate interests, and to object at any time and without justification to processing for direct marketing purposes; not to be subject to a decision based solely on automated processing producing legal effects concerning you or similarly significantly affecting you; and to withdraw your consent at any time, without affecting the lawfulness of processing carried out prior to such withdrawal.
Procedure. Requests may be addressed to privacy@undrgradz.com. We respond within one month, which period may be extended by two further months where the complexity or the number of requests so requires, in which case we will inform you within the first month. Requests are free of charge, save where manifestly unfounded or excessive.
Complaints. You may lodge a complaint with the supervisory authority of your place of habitual residence, your place of work, or the place of the alleged infringement; in the United Kingdom, with the Information Commissioner’s Office; and in Switzerland, with the Federal Data Protection and Information Commissioner. We would nevertheless welcome the opportunity to address your concern in the first instance.
International transfers. Your personal data may be processed in United States and in other countries in which our providers operate, which may not afford an equivalent level of protection. Where that is the case, we rely upon an adequacy decision where one exists, upon the Standard Contractual Clauses adopted by the European Commission together with the UK International Data Transfer Addendum where applicable, and upon supplementary technical, organizational, and contractual measures. A copy of the safeguards in place may be requested at privacy@undrgradz.com.
Responsable. Miguel Tienda, with an address at privacy@undrgradz.com and, 17843 Camino Grande St., San Antonio, Texas 78257 is the responsable for the processing of your personal data under the Ley Federal de Protección de Datos Personales en Posesión de los Particulares and the provisions issued under it.
Data and purposes. The data we process and the purposes for which we process it are set out in Sections 1, 2, and 4. The primary purposes, which are necessary to our relationship with you, are the creation and administration of your account, the provision of the Service, the security of the platform, and compliance with our legal obligations. The secondary purposes, which are not necessary and which you may refuse without any effect upon your use of the Service, are marketing communications and the conduct of surveys or studies for the improvement of the Service.
Sensitive personal data. Certain of the data we process constitutes sensitive personal data under Mexican law. We process it solely with your express and written consent, which we request separately, we use it solely for the purposes stated, and we protect it by means of administrative, technical, and physical security measures appropriate to the nature, sensitivity, and risks of the data.
ARCO rights. You hold the right to request access to your personal data, its rectification where it is inaccurate or incomplete, and its cancellation where you consider that it is not being processed in accordance with the applicable principles and duties, and to object to its processing for particular purposes. You may additionally revoke your consent and limit the use or disclosure of your data.
Procedure and periods. Requests may be addressed to privacy@undrgradz.com, stating your name and a means of contacting you; the documents evidencing your identity or, as applicable, your authority to act on behalf of the data subject; a clear description of the data concerned and of the right you wish to exercise; and any element facilitating the location of the data. We will communicate our determination within 20 days of receipt of the request, and, where the request is granted, we will give effect to it within the 15 days following. Each of those periods may be extended on one occasion, for an equal period, where the circumstances so justify, of which we will inform you together with the reasons.
Transfers. Your data is processed and stored in United States. We transfer it to: Google LLC, our cloud hosting and storage provider, in order that the Service may operate Google (firebase cloud messeging) and resend our messaging, notification, and electronic mail provider, in order that we may communicate with you; our analytics and error-reporting provider, in order to measure and improve the Service; our moderation, verification, and fraud-prevention providers, in order to protect the community; and our payment processors, in order to process your purchases. We may additionally transfer data to competent authorities where required by law, and to a purchaser or successor in the event of a corporate transaction. Transfers requiring your consent under Mexican law will not be effected in its absence.
Authority. You may submit a complaint to the authority competent in respect of the protection of personal data held by private parties, through the body designated for that purpose.
Amendments. We will communicate any amendment to this notice through the Service, by electronic mail, or at Undrgradz.com
Application. Should you be located in Canada, this Section applies to you in addition to the remainder of this Policy. We process personal information in accordance with the federal Personal Information Protection and Electronic Documents Act and, where applicable, the private-sector privacy legislation of the provinces of Alberta, British Columbia, and Quebec.
Person accountable. The individual accountable for our compliance with applicable privacy legislation, to whom any question, request, or complaint may be addressed, may be contacted at support@undrgradz.com.
Purposes and consent. We collect, use, and disclose personal information solely for the purposes described in Section 4, being purposes that a reasonable person would consider appropriate in the circumstances. Consent is obtained at or before the time of collection; express consent is obtained in respect of sensitive personal information, including information revealing sexual orientation and biometric data; and consent may be withdrawn at any time as described in Section 2, subject to legal and contractual restrictions and to reasonable notice. Withdrawal of consent may result in our being unable to provide the Service or a particular feature.
Access and correction. You may request access to the personal information under our control, information as to its use and as to the parties to which it has been disclosed, and the correction of information that is inaccurate or incomplete. We respond within 30 days of receipt of the request, which period may be extended in the circumstances permitted by law, of which extension we will inform you. Access may be refused in the circumstances contemplated by applicable law, in which event we will state the grounds and inform you of the recourse available to you.
Processing outside Canada. Your personal information is processed and stored in the United States and in other countries in which our providers operate. While it is situated outside Canada, it is subject to the laws of the jurisdiction in which it is held and may be accessible to the courts, law enforcement authorities, and national security authorities of that jurisdiction. We employ contractual and other measures designed to afford it a comparable level of protection.
Breach of security safeguards. Where a breach of security safeguards involving your personal information creates a real risk of significant harm, we will notify you and the Office of the Privacy Commissioner of Canada as soon as feasible, and we will maintain records of breaches of security safeguards as required by law.
Automated decisions and portability. We do not render decisions concerning you based exclusively on automated processing, as set out in Section 4; were we to do so, we would inform you at the time of the decision and would afford you the opportunity to submit observations. You may request that the computerized personal information you have provided to us be communicated to you in a structured and commonly used technological format.
Quebec. Should you reside in Quebec, the Act respecting the protection of personal information in the private sector applies to you. Your consent to the processing of sensitive personal information is obtained expressly and separately from any other consent; the privacy settings of your account are configured by default to the highest level of confidentiality; you may request the cessation of dissemination of personal information concerning you, or the de-indexation of any link affording access to it, where the conditions established by that Act are satisfied; and we conduct a privacy impact assessment prior to communicating personal information outside Quebec.
Complaints. A complaint may be addressed to us at support@undrgradz.com. You may additionally address a complaint to the Office of the Privacy Commissioner of Canada; should you reside in Quebec, to the Commission d’accès à l’information du Québec; and should you reside in Alberta or British Columbia, to the Information and Privacy Commissioner of that province.
We may amend this Policy from time to time. Undrgradz opera una plataforma social privada. Esta Política de Privacidad describe la información personal que recabamos, las finalidades para las que la utilizamos, las partes a las que la comunicamos y los derechos y opciones de que dispones respecto de ella.

ELYSA USA LLC (“Undrgradz”, “nosotros” o “nuestro”), con domicilio en 17843 Camino Grande St. San Antonio, Texas 78257, es la entidad responsable de la información personal descrita en esta Política.
El acceso al Servicio está reservado a personas de al menos 18 años de edad.

Confirmamos que una persona usuaria tiene acceso a una dirección de correo electrónico emitida por una universidad o centro de estudios superiores admitido. Ese es el alcance de nuestra verificación. No confirmamos que ninguna persona usuaria esté efectivamente matriculada en ninguna institución, no realizamos comprobaciones de antecedentes penales, y la presencia de una insignia en un perfil no constituye manifestación ni garantía alguna sobre la persona a la que pertenece dicho perfil. Revisa la cláusula 12 de nuestras Condiciones del Servicio antes de quedar en persona con ninguna persona usuaria.
Información de registro: tu nombre, un nombre de usuario, tu fecha de nacimiento, una dirección de correo electrónico emitida por tu institución, una contraseña, un número de teléfono y cualquier código de recomendación que introduzcas.
Información del perfil: fotografías y otros archivos, tu descripción biográfica, tus respuestas a las preguntas, tu institución, tu área de estudio, tu año de promoción, tu lugar de residencia u origen, los idiomas que hablas y los intereses y rasgos de estilo de vida que decidas mostrar. Algunos de estos campos son opcionales, y algunos pueden revelar información sensible; véase la cláusula 2.
Preferencias: las personas usuarias que deseas que se te muestren y los criterios que fijes a tal efecto.
Contenido que generas: mensajes y archivos intercambiados con otras personas usuarias, grupos que creas o a los que te unes, actividades que publicas o a las que asistes, solicitudes que envías y denuncias que nos presentas.
Información de las operaciones: la confirmación de cualquier compra, el artículo o plan adquirido y su estado. No recabamos ni almacenamos el número completo de tu tarjeta de pago, que es tratado por la tienda de aplicaciones o el procesador de pagos correspondiente.
Comunicaciones con nosotros: solicitudes de soporte, denuncias de seguridad, reclamaciones y cualquier otra comunicación que nos dirijas.
Uso del Servicio: las funciones a las que accedes, los contenidos y perfiles que visualizas, las personas usuarias con las que interactúas, las acciones que realizas, la duración de tus sesiones y tus respuestas a las notificaciones.
Información del dispositivo y técnica: modelo del dispositivo, sistema operativo, versión de la aplicación, ajustes de idioma, identificadores del dispositivo, red y operador, dirección IP, y datos de fallos y diagnóstico.
Ubicación aproximada: normalmente a nivel de ciudad o de campus, derivada de tu dirección IP y de la información que facilitas. Si activas los permisos de ubicación en tu dispositivo, podemos utilizar una ubicación más precisa para funciones que dependen de la distancia. Puedes desactivar ese permiso en cualquier momento desde los ajustes de tu dispositivo.
Cookies y tecnologías similares: véase la cláusula 6.
Del sistema de correo electrónico de tu institución, únicamente la confirmación de que se entregó un código de verificación a una dirección admitida. No accedemos a tu buzón, a tus calificaciones ni a tu expediente académico. De las tiendas de aplicaciones y los procesadores de pagos, la confirmación del estado de una compra. De otras personas usuarias, cuando te invitan, interactúan contigo o presentan una denuncia relativa a ti. Y de los proveedores identificados en la cláusula 5, que actúan por nuestra cuenta.
Determinada información que puedes decidir facilitar goza de especial protección conforme a la legislación aplicable. En un servicio de esta naturaleza, esa información puede incluir información relativa a tu vida sexual u orientación sexual (que puede revelarse por los géneros en los que indicas interés), el origen racial o étnico, las creencias religiosas, las opiniones políticas, la geolocalización precisa, los documentos de identidad y los datos biométricos generados en un proceso de verificación.
No recabamos información de salud. No solicitamos, y el Servicio no dispone de campos para ello, información sobre enfermedades, diagnósticos, tratamientos, medicación, discapacidades ni salud reproductiva o mental, y no utilizamos las respuestas sobre estilo de vida, como la alimentación o el ejercicio, para extraer conclusión alguna sobre la salud de ninguna persona.
Tratamos información personal sensible únicamente con tu consentimiento específico y expreso, o cuando resulte aplicable otra base jurídica, como el ejercicio o la defensa de una reclamación legal o la protección de la seguridad de una persona.
Información necesaria, opcional y condicionada.
Retirada del consentimiento. Puedes retirar tu consentimiento en cualquier momento en Ajustes → Legal y privacidad, o mediante solicitud escrita dirigida a privacy@undrgradz.com. Dejaremos de utilizar la información de que se trate y la eliminaremos o anonimizaremos, salvo que estemos obligados a conservarla para cumplir la legislación aplicable, proteger la seguridad de una persona, prevenir el fraude o ejercer o defender una reclamación legal. La retirada del consentimiento respecto de información de la que dependa una función conllevará la desactivación de esa función, y la retirada del consentimiento a una verificación que constituya una condición de acceso puede suponer que no puedas seguir utilizando el Servicio.
Inferencias. Nuestros sistemas clasifican y recomiendan contenidos atendiendo a tu actividad y a otras señales, y cualquier sistema de clasificación puede producir correlaciones indirectas. No creamos intencionadamente perfiles destinados a inferir características sensibles que no hayas decidido facilitar, salvo cuando sea necesario para una función que hayas solicitado y con el consentimiento que exija la legislación aplicable. No vendemos esta información y no la utilizamos con fines publicitarios.
Preferencias. Cuando el Servicio te permita fijar preferencias o filtros atendiendo a atributos personales, esas preferencias constituyen tu propia elección, operan únicamente sobre información que otras personas usuarias han decidido publicar y afectan solo al contenido que se te muestra y al orden en que se muestra. No se utilizan para negar a ninguna persona el acceso al Servicio. Determinados atributos opcionales no están disponibles en todas las jurisdicciones. El uso de cualquier preferencia para excluir, señalar o acosar a cualquier persona o grupo por razón de una característica protegida por la legislación aplicable contraviene nuestras normas, y podemos restringir, desactivar o eliminar cualquier preferencia.
No recabaremos un documento de identidad, una fotografía de verificación ni datos biométricos sin tu consentimiento. Prestar ese consentimiento es en todo momento decisión tuya, y sin él no obtendremos de ti ninguna información de ese tipo; ahora bien, tal y como se indica en la cláusula 2, prestar el consentimiento puede constituir una condición para abrir una cuenta, para mantenerla o para acceder a funciones concretas. Si te niegas, es posible que no puedas utilizar el Servicio o la función de que se trate. Lo decimos expresamente para que ninguna persona usuaria se llame a engaño sobre el significado de “voluntario” en este contexto.
Antes de cualquier aportación de ese tipo, te informaremos de la información que se recabará, de la finalidad concreta de su recogida y del periodo durante el cual se conservará, y obtendremos tu consentimiento por escrito de forma separada.
Utilizamos esta información únicamente para confirmar que cumples los requisitos, tu edad, o que eres la persona que aparece en tus fotografías. No la utilizamos con fines publicitarios, no la vendemos ni cedemos, y no la comunicamos, salvo al proveedor de verificación que actúa por nuestra cuenta en virtud de contrato, cuando hayas autorizado dicha comunicación por escrito, o cuando lo exija la ley, una orden judicial o un mandamiento.
Conservación y destrucción:
Podemos modificar este calendario, la tecnología empleada y nuestras prácticas biométricas periódicamente conforme a la legislación aplicable, dando los avisos y obteniendo los consentimientos que dicha legislación exija en ese momento.
Para operar el Servicio: crear y asegurar tu cuenta, verificar que cumples los requisitos, mostrar tu perfil, presentarte personas usuarias, actividades y contenidos, entregar mensajes y gestionar solicitudes y participación en actividades.
Para personalizar el Servicio: podemos personalizar, clasificar, ordenar, filtrar y recomendar perfiles, actividades y contenidos atendiendo a las preferencias que facilitas, a tu actividad dentro del Servicio y a otras señales.
Para operar las funciones de pago: tramitar compras y suscripciones, entregar los beneficios adquiridos y prevenir el abuso de pruebas, promociones y recompensas por recomendación.
Para proteger a la comunidad: detectar y actuar frente a la suplantación, el fraude, las estafas, el spam, las cuentas automatizadas, las cuentas de personas menores de edad, el acoso, las imágenes no consentidas, las amenazas y otras infracciones; revisar denuncias; y ejecutar expulsiones e impedir el regreso de personas usuarias expulsadas.
Para asegurar el Servicio: autenticar a las personas usuarias, prevenir accesos no autorizados y mantener registros de actividad y de auditoría.
Para comunicarnos contigo: enviar mensajes sobre la cuenta, la seguridad y las operaciones; responder a tus solicitudes; y, cuando hayas decidido recibirlas, enviar comunicaciones comerciales.
Para mejorar el Servicio: analítica, medición, investigación y pruebas, utilizando información agregada o anonimizada siempre que resulte posible.
Para cumplir la legislación aplicable: obligaciones legales, fiscales y regulatorias, requerimientos lícitos de autoridades competentes y el ejercicio o la defensa de reclamaciones legales.
Tratamiento automatizado y revisión humana. Nuestros sistemas de recomendación y de detección de abusos funcionan de forma automatizada. No adoptamos decisiones que produzcan efectos jurídicos sobre ti, o que te afecten significativamente de modo similar, basadas únicamente en tratamiento automatizado: antes de la expulsión permanente de una cuenta, el asunto lo revisa una persona física. Puedes dirigir una solicitud a privacy@undrgradz.com para obtener información sobre dicho tratamiento, expresar tu punto de vista o, cuando la legislación aplicable lo reconozca, oponerte.
Inteligencia artificial. No vendemos tus datos personales para el entrenamiento de modelos de inteligencia artificial de terceros, y no utilizamos el contenido de tus comunicaciones privadas para entrenar modelos de inteligencia artificial generativa. Si esto cambiara, te informaríamos antes de que el cambio surtiera efecto y obtendríamos cualquier consentimiento que exija la legislación aplicable.
A otras personas usuarias. Tu perfil y el contenido que publicas son visibles para las personas usuarias que puedan localizarte, con arreglo a los ajustes que hayas establecido. El contenido que transmitas dentro de una conversación es visible para quienes lo reciban.
A nuestros proveedores de servicios. Alojamiento y almacenamiento, distribución de contenidos, correo electrónico y mensajería de texto, notificaciones push, analítica, notificación de errores, atención al cliente, herramientas de moderación y de confianza y seguridad, verificación y prevención del fraude. Dichos proveedores actúan siguiendo nuestras instrucciones en virtud de contrato escrito, y pueden utilizar tu información únicamente en la medida necesaria para prestar los servicios para los que han sido contratados y para las finalidades conexas que dicho contrato permita, incluidas la seguridad, la prevención del fraude y el cumplimiento normativo, y no para sus propias finalidades independientes. Tienen prohibido venderla.
A las plataformas de pago. Las tiendas de aplicaciones y los procesadores de pagos que tramitan las compras.
A terceros cuyas ofertas mostramos. Cuando mostramos una oferta o descuento de otra empresa, no facilitamos a esa empresa tu información personal por el hecho de que la oferta se te haya mostrado, si bien el proveedor que sirve o mide la oferta puede tratar información técnica en la medida necesaria para entregarla. Si decides canjear la oferta, comunicaremos la información necesaria para validar que cumples los requisitos, y a partir de ese momento la política de privacidad de esa empresa regirá la información que le facilites.
Para fines legales y de seguridad. Cuando creamos de buena fe que resulta necesario para cumplir la legislación aplicable, una citación, una orden judicial o un requerimiento lícito; para hacer cumplir nuestras Condiciones; para prevenir el fraude o incidentes de seguridad; para proteger los derechos, bienes o seguridad de cualquier persona; o para comunicar a las autoridades competentes la sospecha de explotación de una persona menor de edad, conforme exige la ley.
A universidades y centros de estudios superiores. Cuando lo consideremos oportuno para proteger la seguridad de cualquier persona, o cuando lo exija la ley, podemos comunicar conductas ocurridas en el Servicio, junto con la información asociada a la cuenta y a la actividad de que se trate, a la institución con la que la persona usuaria esté vinculada, así como a las fuerzas y cuerpos de seguridad u otras autoridades competentes.
A otras personas usuarias tras la expulsión de una cuenta. Cuando lo exija la legislación aplicable, o cuando determinemos que resulta oportuno para proteger a las personas usuarias, podemos avisar a quienes hayan interactuado con una cuenta que hayamos expulsado por conductas como fraude, acoso o una vulneración de la seguridad. No revelamos la identidad de ninguna persona denunciante.
Contranotificaciones de derechos de autor. Si presentas una contranotificación en respuesta a una reclamación por derechos de autor, la remitiremos, incluidos el nombre, la dirección y los demás datos de contacto que contenga, a la persona que presentó la reclamación original, conforme exige la normativa aplicable de derechos de autor.
En caso de operación societaria. En el marco de una fusión, adquisición, financiación, reorganización, insolvencia o venta de activos, de lo que te informaremos.
Siguiendo tus instrucciones, o con tu consentimiento.
Información agregada o anonimizada que no pueda utilizarse razonablemente para identificarte. Nos comprometemos a no intentar reidentificarla.
No vendemos tu información personal, ni por contraprestación monetaria ni de otro valor. No vendemos información personal sensible ni datos biométricos. No compartimos ni comunicamos tu información personal para publicidad conductual dirigida o entre contextos, y no permitimos que terceros recaben información personal sobre ti a través del Servicio para sus propias finalidades publicitarias. Si esto cambiara, modificaríamos esta Política, avisaríamos antes de que el cambio surtiera efecto y pondríamos a disposición los mecanismos de exclusión que exija la legislación aplicable.
Empleamos tecnologías estrictamente necesarias (autenticación, sesiones y seguridad), funcionales (idioma y ajustes de la persona usuaria) y analíticas (rendimiento de las funciones y notificación de errores). Mantenemos un inventario de los componentes de terceros integrados en la aplicación y en el sitio web, y cada proveedor es contratado como encargado del tratamiento o proveedor de servicios en virtud de contrato escrito.
Cuando la legislación aplicable lo exija, obtenemos tu consentimiento antes del uso de cualquier tecnología no esencial, mediante un mecanismo que te permite aceptar, rechazar y modificar posteriormente tu elección, sin que rechazar resulte más gravoso que aceptar.
Además, puedes gestionar las cookies desde tu navegador y limitar los identificadores publicitarios desde los ajustes de tu dispositivo.
Señales de preferencia de exclusión. Cuando recibimos una señal Global Privacy Control, o cualquier mecanismo universal de exclusión reconocido en tu jurisdicción, la tratamos como una solicitud válida de exclusión de cualquier venta o comunicación de información personal desde ese navegador o dispositivo.
En cualquier momento puedes:
La desactivación de una categoría de tratamiento puede limitar o desactivar las funciones que dependan de ella.
Conservamos tu información mientras subsista tu cuenta y durante el tiempo que sea necesario para las finalidades expuestas en esta Política. Cuando no pueda indicarse un plazo fijo, lo determinamos atendiendo a la finalidad del tratamiento, a los plazos de prescripción aplicables y a nuestras obligaciones legales.

La graduación no conlleva la eliminación de tu cuenta. Tu cuenta se reclasifica como perfil de persona egresada y sigue sujeta a esta Política hasta que la elimines.
Eliminación. Al eliminar tu cuenta, iniciamos la eliminación o anonimización de tu información en el plazo de 12 meses y completamos su supresión de nuestros sistemas de copia de seguridad en el plazo de 24 meses.
Información conservada tras la eliminación. Podemos conservar información limitada para cumplir la legislación aplicable; para preservar material objeto de una comunicación a las autoridades competentes, durante el periodo que exija la ley; para cumplir una orden de conservación o de preservación para un litigio; para resolver controversias y hacer cumplir nuestros acuerdos; para ejercer o defender reclamaciones legales; para mantener la seguridad del Servicio; y para mantener un registro minimizado de las cuentas expulsadas por infracciones graves, de modo que se impida el regreso de una persona usuaria expulsada. Los registros de esta última categoría se limitan a los identificadores estrictamente necesarios para esa finalidad y se conservan durante 12 meses.
Comunicaciones. La eliminación de una conversación de tu vista no conlleva su eliminación del dispositivo o de la cuenta de la otra persona participante.
Mantenemos salvaguardas administrativas, técnicas y físicas, incluidos el cifrado en tránsito y en reposo, controles de acceso con criterio de mínimo privilegio, almacenamiento seguro de credenciales, registro y supervisión, diligencia debida respecto de nuestros proveedores y un procedimiento de respuesta a incidentes.
Ningún sistema es enteramente seguro, y no podemos garantizar una seguridad absoluta. Te recomendamos utilizar una contraseña robusta y única. Cuando un incidente afecte a tu información, te avisaremos a ti y a las autoridades competentes en la forma y dentro de los plazos que exija la legislación aplicable.
Información relativa a otras personas. Cuando invites a una persona, identifiques a una persona o subas contenido en el que aparezca otra persona, eres responsable de tener derecho a hacerlo. No debes facilitar la información de otra persona sin su consentimiento.
El Servicio no está dirigido a, y no puede ser utilizado por, ninguna persona menor de 18 años, o menor de la mayoría de edad en la jurisdicción en la que resida cuando esa edad sea superior. No recabamos conscientemente información de personas menores de edad. Si tuviéramos conocimiento de haberlo hecho, eliminaremos la cuenta y la información asociada sin dilación. Si crees que una persona menor de edad está utilizando el Servicio, escribe a privacy@undrgradz.com.
Según el estado en el que residas, pueden corresponderte los derechos que se exponen a continuación. Reconocemos los derechos exigidos por la ley de privacidad aplicable a tu estado, y podemos atender voluntariamente solicitudes equivalentes presentadas por residentes de estados cuya ley no nos resulta aplicable.
Tus derechos. Con sujeción a verificación y a las excepciones permitidas por la ley, puedes: conocer y acceder a la información personal que tenemos sobre ti y obtener una copia de ella; rectificarla; solicitar su eliminación; obtenerla en un formato portátil; excluirte de la venta de información personal, de la comunicación para publicidad dirigida y de la elaboración de perfiles con efectos jurídicos o similarmente significativos, si bien, tal y como se indica en la cláusula 5, no incurrimos en ninguna de esas prácticas; limitar el uso de información personal sensible a lo necesario para operar el Servicio; retirar cualquier consentimiento; y ejercer todo lo anterior sin sufrir trato discriminatorio.
Procedimiento. Las solicitudes pueden presentarse dentro de la aplicación en Ajustes → Legal y privacidad, por correo electrónico a privacy@undrgradz.com, o por correo postal a P.O. Box 1122 Eagle Pass, Texas 78852. Respondemos en 45 días, plazo que podemos prorrogar otros 45 días cuando sea necesario, informándote del motivo de la prórroga. Debemos poder verificar tu identidad, lo que normalmente hacemos confirmando que controlas la dirección de correo asociada a la cuenta. El ejercicio de tus derechos es gratuito. Conforme a la ley de California, las solicitudes de conocer pueden limitarse a dos en cualquier periodo de doce meses. Podemos rechazar solicitudes manifiestamente infundadas o excesivas, y expondremos los motivos para ello.
Representantes autorizados. Puedes actuar por medio de un representante autorizado, a quien podemos exigir autorización escrita y verificación.
Recursos. Si rechazamos una solicitud, puedes recurrir mediante comunicación escrita dirigida a privacy@undrgradz.com con el asunto “Privacy Appeal” en el plazo de 60 días. Respondemos a los recursos en 60 días, o en el plazo menor que exija la legislación aplicable, por escrito, exponiendo los motivos de nuestra decisión. Si denegamos el recurso, puedes presentar una reclamación ante el Attorney General de tu estado o ante la autoridad de privacidad competente.
Recompensas por recomendación. Nuestro programa de recomendación otorga beneficios dentro de la aplicación cuando las personas a las que invitas se unen al Servicio. Conforme a la ley de California, un programa de este tipo puede constituir un “incentivo económico”. La participación es enteramente voluntaria, puedes dejar de participar en cualquier momento no utilizando tu enlace de recomendación, y la decisión de no participar no tiene efecto alguno sobre tu acceso al Servicio. Hemos valorado el programa de buena fe atendiendo al coste razonable que nos supone ofrecer las funciones adicionales dentro de la aplicación, que es nominal, y consideramos que el valor de la información personal implicada guarda una relación razonable con ese coste.
California — Shine the Light. El California Civil Code § 1798.83 permite a las personas residentes en California solicitar información sobre las comunicaciones de información personal a terceros para las finalidades de márketing directo propias de esos terceros. Las solicitudes pueden dirigirse a privacy@undrgradz.com.
Categorías de información personal. Las categorías de información personal que recabamos, sus fuentes, las finalidades para las que las utilizamos y las categorías de destinatarios a los que las comunicamos con fines empresariales son las expuestas en las cláusulas 1, 4 y 5. No hemos vendido ni compartido información personal, incluida información personal sensible, y no tenemos conocimiento de la venta o comunicación de la información personal de ninguna persona menor de 16 años.
Texas. No vendemos datos personales sensibles ni datos biométricos. Si eso cambiara, facilitaríamos con antelación el aviso exigido por la Texas Data Privacy and Security Act.
Datos de salud del consumidor (Washington y Nevada). No recabamos datos de salud del consumidor. Cuando nos basamos en el interés legítimo, hemos realizado una ponderación, respecto de la cual puedes solicitar información u oponerte.
Tus derechos. Tienes derecho a acceder a tus datos personales; a obtener su rectificación; a obtener su supresión; a obtener la limitación del tratamiento; a la portabilidad de los datos; a oponerte al tratamiento basado en el interés legítimo, y a oponerte en cualquier momento y sin justificación al tratamiento con fines de márketing directo; a no ser objeto de una decisión basada únicamente en el tratamiento automatizado que produzca efectos jurídicos sobre ti o te afecte significativamente de modo similar; y a retirar tu consentimiento en cualquier momento, sin que ello afecte a la licitud del tratamiento realizado con anterioridad.
Procedimiento. Las solicitudes pueden dirigirse a privacy@undrgradz.com. Respondemos en el plazo de un mes, que podrá prorrogarse dos meses más cuando la complejidad o el número de solicitudes así lo requiera, en cuyo caso te informaremos dentro del primer mes. Las solicitudes son gratuitas, salvo que sean manifiestamente infundadas o excesivas.
Reclamaciones. Puedes presentar una reclamación ante la autoridad de control de tu lugar de residencia habitual, de tu lugar de trabajo o del lugar de la supuesta infracción; en el Reino Unido, ante la Information Commissioner’s Office; y en Suiza, ante el Federal Data Protection and Information Commissioner. No obstante, agradeceríamos la oportunidad de atender tu inquietud en primera instancia.
Transferencias internacionales. Tus datos personales pueden tratarse en los Estados Unidos y en otros países en los que operen nuestros proveedores, que pueden no ofrecer un nivel de protección equivalente. Cuando así sea, nos amparamos en una decisión de adecuación cuando exista, en las Cláusulas Contractuales Tipo adoptadas por la Comisión Europea junto con el Addendum de Transferencia Internacional de Datos del Reino Unido cuando resulte aplicable, y en medidas técnicas, organizativas y contractuales complementarias. Puede solicitarse una copia de las garantías establecidas en privacy@undrgradz.com.
Responsable. Miguel Tienda, con domicilio en privacy@undrgradz.com y, 17843 Camino Grande St., San Antonio, Texas 78257 es el responsable del tratamiento de tus datos personales conforme a la Ley Federal de Protección de Datos Personales en Posesión de los Particulares y a las disposiciones emitidas a su amparo.
Datos y finalidades. Los datos que tratamos y las finalidades para las que los tratamos se exponen en las cláusulas 1, 2 y 4. Las finalidades primarias, que son necesarias para nuestra relación contigo, son la creación y administración de tu cuenta, la prestación del Servicio, la seguridad de la plataforma y el cumplimiento de nuestras obligaciones legales. Las finalidades secundarias, que no son necesarias y a las que puedes negarte sin efecto alguno sobre tu uso del Servicio, son las comunicaciones comerciales y la realización de encuestas o estudios para la mejora del Servicio.
Datos personales sensibles. Algunos de los datos que tratamos constituyen datos personales sensibles conforme a la legislación mexicana. Los tratamos únicamente con tu consentimiento expreso y por escrito, que solicitamos por separado, los utilizamos únicamente para las finalidades indicadas y los protegemos mediante medidas de seguridad administrativas, técnicas y físicas adecuadas a la naturaleza, la sensibilidad y los riesgos de los datos.
Derechos ARCO. Tienes derecho a solicitar el acceso a tus datos personales, su rectificación cuando sean inexactos o incompletos, y su cancelación cuando consideres que no están siendo tratados conforme a los principios y deberes aplicables, así como a oponerte a su tratamiento para finalidades concretas. Además, puedes revocar tu consentimiento y limitar el uso o la divulgación de tus datos.
Procedimiento y plazos. Las solicitudes pueden dirigirse a privacy@undrgradz.com, indicando tu nombre y un medio para contactarte; los documentos que acrediten tu identidad o, en su caso, tu facultad para actuar en nombre del titular; una descripción clara de los datos de que se trate y del derecho que deseas ejercer; y cualquier elemento que facilite la localización de los datos. Comunicaremos nuestra determinación dentro de los 20 días siguientes a la recepción de la solicitud y, cuando la solicitud sea procedente, la haremos efectiva dentro de los 15 días siguientes. Cada uno de esos plazos podrá prorrogarse por una sola vez, por un periodo igual, cuando las circunstancias lo justifiquen, de lo que te informaremos junto con los motivos.
Transferencias. Tus datos se tratan y almacenan en los Estados Unidos. Los transferimos a: Google LLC, nuestro proveedor de alojamiento y almacenamiento en la nube, para que el Servicio pueda operar; Google (Firebase Cloud Messaging) y Resend, nuestros proveedores de mensajería, notificaciones y correo electrónico, para que podamos comunicarnos contigo; nuestro proveedor de analítica y notificación de errores, para medir y mejorar el Servicio; nuestros proveedores de moderación, verificación y prevención del fraude, para proteger a la comunidad; y nuestros procesadores de pagos, para tramitar tus compras. Además, podemos transferir datos a autoridades competentes cuando lo exija la ley, y a un comprador o sucesor en caso de operación societaria. Las transferencias que requieran tu consentimiento conforme a la legislación mexicana no se efectuarán sin él.
Autoridad. Puedes presentar una reclamación ante la autoridad competente en materia de protección de datos personales en posesión de los particulares, a través del órgano designado a tal efecto.
Modificaciones. Comunicaremos cualquier modificación de este aviso a través del Servicio, por correo electrónico o en Undrgradz.com
Ámbito de aplicación. Si te encuentras en Canadá, esta cláusula te resulta aplicable además del resto de esta Política. Tratamos información personal conforme a la Personal Information Protection and Electronic Documents Act federal y, cuando proceda, a la legislación de privacidad del sector privado de las provincias de Alberta, Columbia Británica y Quebec.
Persona responsable. La persona responsable de nuestro cumplimiento de la legislación de privacidad aplicable, a quien puede dirigirse cualquier consulta, solicitud o reclamación, puede contactarse en support@undrgradz.com.
Finalidades y consentimiento. Recabamos, utilizamos y comunicamos información personal únicamente para las finalidades descritas en la cláusula 4, que son finalidades que una persona razonable consideraría adecuadas en las circunstancias. El consentimiento se obtiene en el momento de la recogida o antes; se obtiene consentimiento expreso respecto de la información personal sensible, incluida la que revela la orientación sexual y los datos biométricos; y el consentimiento puede retirarse en cualquier momento conforme a lo descrito en la cláusula 2, con sujeción a restricciones legales y contractuales y a un preaviso razonable. La retirada del consentimiento puede suponer que no podamos prestar el Servicio o una función concreta.
Acceso y corrección. Puedes solicitar el acceso a la información personal bajo nuestro control, información sobre su uso y sobre las partes a las que se ha comunicado, y la corrección de la información inexacta o incompleta. Respondemos dentro de los 30 días siguientes a la recepción de la solicitud, plazo que puede prorrogarse en las circunstancias permitidas por la ley, prórroga de la que te informaremos. El acceso puede denegarse en las circunstancias contempladas por la legislación aplicable, en cuyo caso expondremos los motivos y te informaremos de los recursos a tu disposición.
Tratamiento fuera de Canadá. Tu información personal se trata y almacena en los Estados Unidos y en otros países en los que operan nuestros proveedores. Mientras se encuentre fuera de Canadá, está sujeta a las leyes de la jurisdicción en la que se halle y puede ser accesible a los tribunales, a las autoridades policiales y a las autoridades de seguridad nacional de esa jurisdicción. Empleamos medidas contractuales y de otro tipo destinadas a otorgarle un nivel de protección comparable.
Vulneración de las medidas de seguridad. Cuando una vulneración de las medidas de seguridad que afecte a tu información personal genere un riesgo real de daño significativo, te lo notificaremos a ti y a la Office of the Privacy Commissioner of Canada tan pronto como sea posible, y mantendremos registros de las vulneraciones de las medidas de seguridad conforme exige la ley.
Decisiones automatizadas y portabilidad. No adoptamos decisiones sobre ti basadas exclusivamente en tratamiento automatizado, conforme se expone en la cláusula 4; si lo hiciéramos, te informaríamos en el momento de la decisión y te daríamos la oportunidad de presentar observaciones. Puedes solicitar que la información personal informatizada que nos hayas facilitado te sea comunicada en un formato tecnológico estructurado y de uso corriente.
Quebec. Si resides en Quebec, te resulta aplicable la Ley sobre la protección de la información personal en el sector privado. Tu consentimiento al tratamiento de información personal sensible se obtiene de forma expresa y separada de cualquier otro consentimiento; los ajustes de privacidad de tu cuenta están configurados por defecto al nivel más alto de confidencialidad; puedes solicitar el cese de la difusión de información personal que te concierna, o la desindexación de cualquier enlace que dé acceso a ella, cuando se cumplan las condiciones establecidas por dicha Ley; y realizamos una evaluación de impacto sobre la privacidad antes de comunicar información personal fuera de Quebec.
Reclamaciones. Puede dirigirse una reclamación a nosotros en support@undrgradz.com. Además, puedes dirigir una reclamación a la Office of the Privacy Commissioner of Canada; si resides en Quebec, a la Commission d’accès à l’information du Québec; y si resides en Alberta o en Columbia Británica, al Information and Privacy Commissioner de esa provincia.
Podemos modificar esta Política periódicamente. Publicaremos la versión modificada con una nueva fecha de “Última actualización” y, en el caso de modificaciones sustanciales, avisaremos a través del Servicio o por correo electrónico antes de que surtan efecto, y obtendremos tu consentimiento cuando lo exija la legislación aplicable.
